We have allowed a period between our last report in March 2005 and the present date to give the Aristo sufficient time to take all necessary actions to comply with Owners Requirements, remedy the failed wall, ensure the integrity of the foundations of the properties, repair structural damage to properties, to replace/repair the adjoining area and to issue a all reports and a 12 year guarantee. Lack of action leads us to the conclusion that Aristo have no intention of fulfilling their obligations.
We are concerned about various not insubstantial vertical cracks that are appearing in the new retaining wall (see photographs). The cracks vary in length between 1 and 4 meters and presently number 34. They appear to be structural cracks and not surface splits in the ‘gunite’ sprayed finish. Cracks and split joints 3 to 4 meters long have already opened up in 3 patios. One dividing wall between properties has cracked from one side to the other and from top to bottom. (see photograph). Moreover, cracks in the
